1.0 – draft for legal review before publishing
These Terms of Use govern access to and use of the NOTEQ digital platform, including its web application, mobile interfaces, and related features.
NOTEQ is a platform for musicians, bands, event organizers, and others involved in arranging or performing at music events.
By using the platform or creating an account, the user confirms they have had the opportunity to review these Terms.
If the user disagrees with these Terms, they should not create an account or continue using features that require acceptance.
The operator of the NOTEQ platform is:
INTERNAL NOTE: Before publishing, verify with a lawyer whether NOTEQ's business model requires registration of a business activity and whether an individual can legally charge subscriptions to users in RS and the EU.
For the purposes of these Terms:
NOTEQ allows users to, depending on available features and account type:
NOTEQ currently does not include an ads/listings module or in-app payment processing. If new features are introduced, relevant terms will be updated before activation.
The operator may develop, modify, suspend, or discontinue features, subject to applicable legal obligations and any contractual rights of users.
Registration is required to use certain features. During registration, the user must provide accurate, up-to-date information.
The user must not impersonate others, use third-party credentials without permission, provide false information, create multiple accounts to circumvent restrictions, or use automated methods for mass account creation.
The user must keep login credentials confidential. Suspected unauthorized access should be reported to [email protected] immediately.
The platform is open to users of all ages. If the user is a minor, use of the platform implies the knowledge and consent of a parent or legal guardian, who assumes responsibility for compliance with these Terms.
The user is solely responsible for the legality of their activities, the accuracy of published information, and respect for the rights of others.
Users may create and maintain music profiles in accordance with platform features.
A user managing a band profile must have appropriate authority and must not falsely represent a band or member who has not authorized them.
The operator does not automatically resolve disputes between band members regarding profile ownership, band name, or content.
NOTEQ provides technical tools for recording and organizing bookings and performance schedules. The operator is not a party to agreements between users and assumes no responsibility for their fulfillment.
A booking record in NOTEQ does not by itself constitute a contract between users or guarantee that a performance will take place. Users are responsible for clearly agreeing on all terms of an engagement.
NOTEQ does not currently process or transfer funds for performance payments.
This provision does not exclude the operator's liability in cases where it is prescribed by law.
The user retains rights they hold over uploaded content. By uploading content, the user grants the operator a non-exclusive, royalty-free license limited to what is necessary for platform operation: hosting, displaying, technical processing, and distribution through platform features.
This license does not transfer ownership of content or permit commercial use beyond the stated purposes.
The user is responsible for holding the necessary rights to upload photos and other materials that may be protected by copyright or third-party privacy rights.
After account deletion or content removal, the operator will remove content from public display and active systems within a reasonable technical timeframe. Temporary copies in backup systems may remain during a regular technical cycle, in accordance with the Privacy Policy.
Users must respect the rights of authors, performers, producers, photographers, trademark holders, and other rights holders.
If a user believes their rights are being infringed via the platform, they may submit a report as described in Section 13.
Users are prohibited from using NOTEQ for fraud, impersonation, unlawful content, harassment, spam, unauthorized data collection, system intrusion, malware distribution, circumventing suspensions, or any other activity contrary to applicable law or these Terms.
Users may report content via [email protected]. We distinguish: (a) unlawful content reports — describe why content is unlawful and provide its identifier; (b) copyright/IP violation reports — include description, identifier, rights basis, and contact details; (c) account abuse reports — describe the incident and identify the relevant account where possible.
The operator will act without unnecessary delay and may request additional information, temporarily restrict access to content, remove it, or decline the report if there is no basis for action.
LEGAL REVIEW: Align reporting timelines and procedures with applicable e-commerce regulations. Specific deadlines are not stated in this draft until confirmed.
The operator may restrict features, remove content, suspend, or terminate an account if there are justified grounds: serious or repeated Terms violation, unlawful content, fraud, security threats, or a binding legal order.
The operator will apply a proportionate measure. Where appropriate, the user will be notified and may request reconsideration at [email protected].
Account suspension does not release the user from obligations assumed toward other users.
NOTEQ does not currently charge subscriptions or process in-app payments for performances.
If paid subscriptions or other charged features are introduced, users will be clearly informed before activation. Relevant terms will be updated accordingly.
The operator aims to keep NOTEQ available but does not guarantee uninterrupted service. Temporary unavailability may result from maintenance, upgrades, security interventions, or circumstances beyond the operator's control.
This provision does not exclude the operator's liability to the extent that it cannot be limited by law.
The NOTEQ name, logo, interface design, and software code that the operator owns or holds an appropriate license to are protected by applicable intellectual property law. This provision applies only to elements for which the operator holds appropriate rights.
Without authorization, users may not copy, distribute, sell, modify, or decompile protected platform elements, except to the extent permitted by mandatory law.
To the extent permitted by law, the operator is not liable for another user's failure to fulfill their obligations or for damage solely caused by another user's actions.
Nothing in these Terms excludes liability that cannot be excluded under mandatory law, including liability for intent or gross negligence.
The operator may modify these Terms. Each new version carries a date of entry into force stated at the top of the document.
For significant changes, users will be notified in advance via the application or email. Where a new acceptance is required, the operator will request it explicitly.
Changes do not apply retroactively to rights and obligations that already arose.
This version of the Terms enters into force on October 28, 2026.
Account deletion requests can be sent to [email protected]. Deletion involves: removal from public display (immediate or short technical delay); deletion from active systems within 7 days of the confirmed request; backup retention during a regular technical cycle per the Privacy Policy; and retention of certain data if required by law.
These Terms are governed by the law of the Republic of Serbia. Nothing deprives users of the protection afforded by mandatory law, including consumer protection rules.
